Presented by Jordan Fischer, Esq. and Rebecca Rakoski, Esq., this conference brings together cybersecurity professionals from the region and around the country to provide advice and guidance to in-house and private practice attorneys on cybersecurity legal issues. This practical and informative CLE event is a live, in-person seminar that will provide attorneys with six (6) hours, including two (2) ethics, of live, in-person CLE hours.
Session 1: Preparation is Key: Data Management in the Age of Cybersecurity
This session will focus on data management best practices to create an effective, clearly defined system in light of the inevitability of cybersecurity issues. With the increasing volume of data — emails, messaging platforms, social media, mobile devices, etc. — a key component of any “secure” system is clear and organized data management. This is compounded by an increasingly mobile or work-from-home workforce, which increases the risk of a cyber breach. This session will explore the ethical and regulatory requirements in cybersecurity and the available options to minimize risk and optimize data management efficiencies. Lawyers are increasingly coming under scrutiny for her or his own data management policies. With increased pressure the client and the added burdens of ethical responsibilities to maintain the confidentiality of client data, secure data management by attorneys is key to meeting client demands and attorney ethical responsibilities.
Session 2: The Growing Contrasts in Domestic and International Privacy and Protection Laws
This session will focus on the growing divergence on an international level in the way that countries and regions approach data privacy and protection. This discussion will contrast the growing regulatory environment in Europe with the forthcoming General Data Protection Regulation (GDPR) and the active role of the European courts with the more narrow, industry specific approach in the United States. Further, this session with explore data protection legislation in other regions, including China and Australia.
Session 3: The Effect of Cybersecurity and Privacy Laws on Cross-Border Litigation
This session will focus on the potentially conflicting obligations that can arise between litigation and cybersecurity and privacy compliance. The intersection of discovery, privacy, and cybersecurity involves the exchange, transfer, and processing of sensitive information. In-house and outside attorneys need to be aware of the data relevant in litigation and the implications of the use of that data on a client’s privacy and cybersecurity obligations. Discussions should go beyond just the internal data management but should include the security and data management of any recipient of a client’s data. Additionally, the intersection of privacy, cybersecurity, and litigation creates ethical obligations on the part of the attorney: obligations to ensure that the client is adequately meeting its discovery requirements, while also ensuring that the release of certain data does not create a privacy liability or create a cybersecurity risk, for both the law firm and the client.
