Program Overview
This program is the definitive source for counsel to obtain practical strategies for compliance with the latest bankruptcy regulations, laws, best practices and will explain the fundamentals of bankruptcy. Topics covered include structure of the Code; commencing the case; concepts such as discharge, property of the estate, claims, priority, ethics, adequate protection and the automatic stay; executory contacts and leases; chapter 7 from both the debtor and creditor perspectives.
Presented by David Doyaga, Esq. and Jonathan Stanwood, Esq., this conference brings together bankruptcy professionals from the region and around the country to provide advice and guidance to in-house and private practice attorneys on bankruptcy legal issues. This practical and informative CLE event is a live, in-person seminar that will provide attorneys with six (6) hours, including one and a half (1.5) ethics, of live, in-person CLE hours.
Session 1: Client Intake, Retainer, The Discharge and The Stay
This session will focus on a comprehensive overview of the bankruptcy process, specifically of Chapter 7 bankruptcy. The main areas covered include recent trends, counseling clients, whether Chapter 7 is a good option for your client. Further topics addressed include the emotional needs of clients, Chapter 7 vs. Chapter 13, the means test, the initial consultation, red flags, alternatives to Chapter 13, the pre-filing credit counseling course, and income tax.
Session 2: The Petition and the 341 Meeting
This session will build upon the first session and discuss the necessary forms & documents and resources, Preparing an actual petition and filing the petition on the courts website, the Trustee’s meeting also known as the 341 meeting of creditors and Client Prep for the 341 meeting.
Session 3: The Nuances of State and Federal Exemptions and The Basics of Chapter 13 Practice
This session will focus on a comprehensive overview of the bankruptcy process, specifically of Chapter 13 bankruptcy. The main areas covered include recent trends, counseling clients, whether Chapter 13 is a good option for your client, the necessary forms & documents and resources. Further topics addressed include the emotional needs of clients, Chapter 7 vs. Chapter 13, the means test, the initial consultation, red flags, alternatives to Chapter 13, the pre-filing credit counseling course, income tax, the meeting of creditors, Schedules A – J and helpful bankruptcy websites.

We understand that you may have a reporting deadline and that you would like to make sure your time was well spent which is why immediately after attending one of our programs we provide you with a Certificate of Attendance as proof that you have satisfied a number of your CLE credits. If you are admitted to practice in Philadelphia we submit your credits directly to the PA CLE board no later than 48 hours after an event.
